试用期员工,想炒就炒?

有些雇主认为试用期内雇佣双方劳动关系处于未完全建立状态,他们可以随意解雇员工。然而在许多案例中显示,雇主要解雇试用期员工,也必须要有正当的、合理的及公正的理由(Just cause or excuse).

1)Khaliah Abbas v Pesaka Capital Corp Sdn Bhd [1997 ]案例中,上诉法庭在Klaliah Abbas的案件列明, 试用期员工应该享有和正式员工相同的保障,在解雇过程中也必须要有正当的、合理的及公正的理由(Just cause or excuse).

2)RANBAXY (MALAYSIA) SDN BHD v. VIJAYA A RAJADURAI [1999] 1 ILR 430案例里也提到,如果雇主要合理解雇一名试用期员工,必须证明那名表现不佳的工人已得到警告,并给工人充分的机会来改善;但他没能有效地提高表现。雇主也必须在解雇表现不佳的员工之前,给员工一份书面警告。

假如试用期员工觉得自己被无理解雇,他们可于60天内在马来西亚工业关系法(Industrial Relations Act) 第20条下向有关部门做出适当的投诉。
